Legislation signed in July changes the method in which veterans facing foreclosure can obtain relief provided by they federal government. While home loan programs to assist men and women who served in the armed forces date back to World War II, numerous revisions have occurred since then. The current iteration is designed to give veterans and their families the time they need to pay off their mortgage without having to worry about losing their home. 

The VA Home Loan Program Reform Act established what is referred to as a “partial claim” program. This means that a veteran who has fallen behind on their mortgage obligation can shift their responsibility for the missed payments to the end of their loan term. With the VA advancing the funds needed to catch up, former members of our military services do not have to face the risk of foreclosure. In exchange for the relief, a lien is created that can be repaid when the mortgage matures, or when the home is sold or refinanced. 

Previously, the Veterans Affairs Servicing Program (VASP) used a different approach. Under VASP, a veteran having severe difficulty making mortgage payments could apply to have their loan purchased by the VA, which could offer more manageable terms. This program, ended on May 1, 2025, was seen as a last resort. Conversely, the partial claim model is designed to be more flexible and enable earlier intervention so that veterans and their families are not pushed to the brink of foreclosure before receiving their benefit.

Even if you are a veteran or married to one, it is worthwhile to explore alternative methods of foreclosure protection as well. A partial claim does not erase debt; it moves arrears into a separate, repayable amount tied to your home’s future equity events.
