Filing for bankruptcy might be the best way to tackle overwhelming debt and gain the financial freedom you deserve. As you pursue this form of legal relief, it’s important to understand that bankruptcy is a powerful tool reserved for those who truly require it. Actions or social media posts that make it appear like you are enjoying a lavish lifestyle could threaten your ability to achieve a successful resolution, and likely will antagonize the trustee, your creditors and the court.

Former NFL star Antonio Brown learned this lesson in the creditors’ meeting conducted as part of his Chapter 7 bankruptcy proceeding. The retired wide receiver has populated his social media feed with photos from Dubai where he’s wearing expensive jewelry and driving flashy sports cars. He has also mentioned cryptocurrency holdings that are not listed in the documents submitted with his bankruptcy.

Even misleading images or statements can raise questions about Inconsistencies between what you filed under oath and your true financial status. Brown indicated that the luxurious trappings in his photos reflected assets actually owned by friends, but additional steps might be taken to ascertain what is true. This could delay a debt discharge or threaten it entirely.

Conversely, removing content after filing may be viewed as spoliation or an attempt to conceal information. The best policy is to hold off on glamorous-looking posts from the point where you start considering seeking bankruptcy relief. Avoid sharing travel, high-end purchases or lifestyle content until your case concludes. Tighten privacy settings, but assume nothing is truly private. Friends, tags and public comments can still surface.

Your attorney can guide you on the best way to avoid unnecessary complications during bankruptcy. If you have access to a car you don’t own, travel paid by someone else or borrowed items that might convey a false image of wealth, tell your lawyer and document it. Maintain receipts, loaner agreements sponsorship emails and proof of who paid for what.
