Even when people understand that the money they’re getting is what they overpaid to the government over the previous year, the payment can feel like a little bonus. However, if you filed for Chapter 13 bankruptcy and are currently in the midst of your repayment schedule, you might wonder if you’ll get to keep those funds from the IRS or New Jersey Division of Revenue.

Whether your tax refund will be distributed to creditors depends on the specific circumstances. Generally, the bankruptcy trustee takes control of funds that a Chapter 13 debtor receives outside of the income used to formulate their repayment plan. While a tax refund usually qualifies as disposable income, a debtor might not have to give it up if they are already scheduled to pay back most or all of their obligations. 

When a Chapter 13 filer has what is referred to as a “100 percent plan,” they usually can retain additional income because their creditors are slated to receive everything they are owed within three to five years. In many circumstances involving tax refunds, this grace extends to filers whose schedules are designed to provide at least 70 percent repayment. Each case has unique elements though, so it is important to work with a qualified attorney who can negotiate a plan that best suits your situation and needs.  

As your finances are subject to the scrutiny and control of the bankruptcy trustee, it might be a good idea to review your withholding amounts if you’re worried about a sizeable refund being taken away. This can contribute to a stable income flow year-round.
